TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the services provided by Indy Tangles (“we”, “us”, “I”, “our”, “Company”), based in Connecticut, USA.
By enrolling in our classes, workshops, or using our online/offline offerings (collectively, the “Services”), you agree to these Terms. If you do not agree to all of these Terms, you must not use or access the Services.
1. Services
We provide art-based services including (but not limited to) in-person classes, online lessons, workshops, mentoring, art materials guidance, critique sessions and other educational programs (together, the “Services”). We may change the scope, format, schedule or method of delivery of the Services at our discretion.
2. Eligibility
By using the Services, you represent and warrant that you are at least 18 years of age (or, if under 18, that you have obtained your parent’s or legal guardian’s consent to use the Services and are bound by these Terms). You also represent that you have the legal capacity to enter into this agreement and will abide by all applicable laws.
3. Registration, Payment & Cancellation
You must register for the Services through our website, by email, or by other method we designate.
Payment for the Services is required in the amount, at the time, and by the method we specify (e.g., credit card, PayPal, bank transfer).
Unless otherwise stated, fees are non-refundable once the Services begin, except in cases where we cancel the Services or otherwise indicate in our refund policy.
If you wish to cancel or reschedule a class or workshop, you must give notice at least [specify number] hours/days in advance. Failure to do so may result in forfeiture of the fee or partial refund based on our cancellation policy.
4. Conduct & Expectations
You agree to participate fully in the Services, follow the instructor’s directions, use materials safely, and maintain a respectful environment for all participants.
You agree not to engage in disruptive, abusive, harassing or illegal conduct. We reserve the right to deny and/or remove a participant from a class or workshop at our discretion for failure to comply.
If you use our online platform (if applicable), you agree not to share your login credentials, not to copy/distribute course materials unless expressly permitted, and to abide by our usage guidelines.
5. Intellectual Property
All instructional materials, lesson plans, video recordings, handouts, and other content provided as part of the Services are the intellectual property of Indy Tangles (or our licensors) and are protected by copyright, trademark and other laws.
You are granted a limited, non-exclusive, non-transferable license to use such materials for your personal, non-commercial use only, in the context of the Services. You may not reproduce, distribute, publicly display, create derivative works from, or resell the materials unless we expressly permit in writing.
You remain the owner of any artworks you create as part of the Services, unless we agree otherwise in writing. However, by participating you grant us a licence (non-exclusive, worldwide, royalty-free) to use images of your artwork for our promotional purposes (e.g., website, social media), unless you opt out in writing.
Each class will have specific terms to accept before purchase.
6. Disclaimers & Limitation of Liability
The Services are provided “as is” and “as available.” We make no warranty (express or implied) regarding the accuracy, reliability, or suitability of the Services for your particular needs.
We are not responsible for any indirect, incidental, special or consequential damages arising out of your participation in the Services, including but not limited to loss of profits, loss of data, personal injury or other harm, whether based on warranty, contract, tort (including negligence) or any other legal theory.
In no event shall our liability exceed the amount you paid for the specific Services giving rise to the claim.
7. Termination
We may terminate or suspend your access to any or all of the Services immediately, without prior notice or liability, if you breach these Terms or for other reasons.
Upon termination, your license to use the instructional materials ends and you must cease all use of full-access materials.
Sections 4 (Conduct & Expectations), 5 (Intellectual Property), 6 (Disclaimers & Limitation of Liability), 8 (Indemnification), 9 (Governing Law & Dispute Resolution) and any other surviving provisions shall survive termination.
8. Indemnification
You agree to defend, indemnify and hold harmless Indy Tangles, its instructors, officers, employees, agents and affiliates from and against any claims, liabilities, damages, losses, costs or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms or your participation in the Services.
9. Governing Law & Dispute Resolution
These Terms and your participation in the Services shall be governed by and construed in accordance with the laws of the State of Connecticut, USA, without regard to its conflict of law provisions. You and we agree to submit to the exclusive jurisdiction of the state and federal courts located in [specify county], Connecticut for any disputes arising hereunder.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Waiver & Severability: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations freely.
Notices: We may provide you with notices by means of email, postal mail, or postings on our website.
Relationship: Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and Indy Tangles.
